Cantaloupe Technologies Corporation (Cantaloupe AI) Privacy and Data Usage Policy

This User Agreement ("Agreement") is a legal document between you ("User" or "Applicant") and Cantaloupe Technologies Corporation ("Cantaloupe AI," "we," "our," or "us") governing your access and use of our pre-screening tools, including Cantaloupe AI’s Pre-Screener (V2) and Cleo, our conversational AI tool powered by Vapi AI.

By using Cantaloupe AI, you agree to comply with this Agreement and acknowledge our data practices as described herein.

1. Purpose of Cantaloupe AI Tools

Cantaloupe AI’s tools provide supplementary employment data to assist employers in assessing candidate compatibility and early turnover likelihood. Our platform does not make hiring decisions, offer jobs, or assess financial or credit information. All hiring decisions are made by human decision-makers employed by our clients.

2. Compliance with Laws

Cantaloupe AI is committed to adhering to all applicable laws, including but not limited to:

  • Equal Employment Opportunity (EEO) Compliance:
    • While Cantaloupe AI tools facilitate pre-screening, employers are responsible for ensuring compliance with federal, state, and local employment laws. This includes preventing discrimination based on race, gender, religion, national origin, age, disability, or other protected characteristics.
  • Fair Credit Reporting Act (FCRA):
    • Cantaloupe AI does not assess financial or credit information, and therefore does not fall under the scope of the FCRA.
  • State Privacy Laws:
    • Cantaloupe AI complies with all U.S. privacy laws, including the California Consumer Privacy Act (CCPA), Virginia Consumer Data Protection Act (VCDPA), and other similar state laws.

3. Non-Discrimination Clause

Cantaloupe AI explicitly does not collect, analyze, or evaluate information regarding an Applicant’s race, gender, sexual orientation, religion, national origin, socioeconomic status, or any other legally protected characteristic. Our tools are designed to promote fairness and inclusivity by focusing solely on job-relevant factors.

4. Data Collection

When using Cantaloupe AI’s tools, we collect the following data from Applicants:

  • Job Experience: Information related to previous roles, responsibilities, and industries.
  • Skills: Assessment of hard and soft skills relevant to the position.
  • Personality Traits: Insights into personality using widely recognized frameworks (e.g., Big Five).
  • Soft Skills: Indicators such as communication, teamwork, and adaptability.
  • Proximity to Work: Geographic location and commuting feasibility.
  • Cues and Emotions: Analysis of tone, inflection, and non-verbal indicators to assess compatibility.
  • Availability: Scheduling preferences and alignment with role requirements.
  • Speech and Transcription Data: Data generated during interactions with Cleo, our conversational AI.

Optional Data Collection:

Users may opt out of providing certain types of data (e.g., emotion detection or proximity). However, opting out may impact the overall assessment score, which could influence how hiring decision-makers interpret the results.

5. Privacy Practices

We value your privacy and take extensive measures to protect your data:

  • Data Usage: Data is used solely to generate supplementary employment insights for employers.
  • Data Sharing: Your data is shared only with the employer or organization that requested your pre-screening interview.
  • Data Retention: Data is retained for as long as necessary to fulfill its purpose or as required by law. Users may request data deletion where permissible.
  • Data Protection: All data is encrypted and protected using industry-standard security measures.
  • Third-Party Tools: Some components of the service use third-party AI tools (e.g., Vapi AI). These tools comply with our privacy and security policies.

6. User Consent

Participation in the Cantaloupe AI screening interview is mandatory for Applicants whose employers require it. By proceeding with the interview, you:

  • Consent to the collection and use of your data as outlined in this Agreement.
  • Acknowledge that opting out of certain data collection may impact your assessment score.

7. Applicant Responsibilities

  • Applicants must provide accurate and truthful information during the screening process.
  • Misrepresentation or falsification of information may result in invalid results and may impact hiring decisions.

8. Employer Responsibilities

Employers are responsible for ensuring that their use of Cantaloupe AI tools complies with all applicable employment laws, including but not limited to:

  • Preventing unlawful discrimination.
  • Ensuring equitable treatment of all Applicants.
  • Providing Applicants with any legally required disclosures.

9. Disclaimer of Liability

Cantaloupe AI provides supplementary data only and does not guarantee hiring outcomes or compliance with employment laws. Employers retain full responsibility for their hiring decisions and practices.

10. Opt-Out and Access Rights

Applicants have the following rights:

  • Access: Request access to data collected about them.
  • Correction: Request corrections to inaccurate information.
  • Deletion: Request deletion of data where permissible by law.
  • Opt-Out: Opt out of non-mandatory data collection (e.g., emotion detection). Opting out may impact assessment results.

11. Updates to this Agreement

Cantaloupe AI reserves the right to update this Agreement at any time. Users will be notified of significant changes and must review and accept the updated terms before continuing to use our tools.

12. Governing Law

This Agreement is governed by the laws of the State of Louisiana. Any disputes arising from this Agreement shall be resolved in the courts located in New Orleans, Louisiana.

13. Acknowledgment and Acceptance

By using Cantaloupe AI tools, you acknowledge that you have read, understood, and agreed to the terms of this Agreement, including our data practices and privacy policy.
